美国关于禁止部分中共人员入境法案 - 简称为“2011中国民主促进案”

    新泽西州的史密斯先生(代表自己、Mr. WOLF, Mr. BURTON of Indiana, and Mr. ROHRABACHER)介绍以下被交送司法委员会的法案:

法  案
    中华人民共和国的部分政府高级领导人以及在中华人民共和国境内实施侵犯人权行为的个人,因其侵犯人权行为以及其他原因,美利坚合众国拒绝其进入美利坚合众国。

    通过美利坚合众国的参议院和众议院代表集体制定。

第一节:简称
    此法令可被简称为“2011中国民主促进案”。

第二节:对中华人民共和国的部分政府高级领导人以及在中华人民共和国境内实施侵犯人权行为的个人进入美利坚合众国境内的禁令。

    无论其他法律条文如何规定,根据《移民与国籍法》212(F)(8 U.S.C.1182(F)),总统可行使拒绝任何符合以下条件的外国人进入美利坚合众国的权力:

  (1)在中华人民共和国政府拥有高级领导地位;

  (2)属于(1)中不予准许进入美利坚合众国的人员的近亲属;

  (3)通过与中华人民共和国政府高级领导人员的业务往来,而从政府政策或其他政府行为(包括侵犯人权、贪污、破坏或侵害民主组织或其他阻碍中华人民共和国民主发展的行为)中取得重要经济利益的任何个人;

  (4)参与强制实施中华人民共和国计划生育;

  (5)参与暴力镇压或逼迫藏族、维吾尔族、蒙古族以及其他少数民族;

  (6)参与贩卖北朝鲜难民或者在明知这些难民返回北朝鲜后将面临逼迫的情况下仍将其强制遣返北朝鲜;或者

  (7)任何属于中华人民共和国安全或执法部门及其分支机构的成员,曾参与实施暴力镇压,监禁、酷刑或者其他任何形式的侵犯人权的对以下特定个体的逼迫行为,包括:

   (A)宗教组织的领袖或者成员;

   (B)民主提倡者、组织者或者示威者;

   (C)任何参与人权辩护和倡导或者公共利益问题的公益律师事务所或者其他机构的成员或个人;

   (D)工人权利的倡导者;

   (E)参与独立媒体、传媒工作的个人或者网络使用者。

To deny the entry into the United States of certain members of the senior      leadership of the Government of the People’s Republic of China and individuals     who have committed human rights abuses in the People’s Republic of China, and      for other purposes.

     Mr. SMITH of New Jersey (for himself, Mr. WOLF, Mr. BURTON of Indiana,and Mr.      ROHRABACHER) introduced the following bill; which was referred to the Committee     on the Judiciary

A BILL
          To deny the entry into the United States of certain members of the senior      leadership of the Government of the People’s Republic of China and individuals     who have committed human rights abuses in the People’s Republic of China, and      for other purposes.

     Be it enacted by the Senate and House of Representatives of the United States      of America in Congress assembled,
  
SECTION 1. SHORT TITLE.

This Act may be cited as the “China Democracy Promotion Act of 2011”

     SEC. 2. DENIAL OF ENTRY INTO THE UNITED STATES OF THE SENIOR LEADERSHIP OF THE     GOVERNMENT OF THE PEOPLE’S REPUBLIC OF CHINA AND INDIVIDUALS WHO HAVE COMMITTED     HUMAN RIGHTS ABUSES IN THE PEOPLE’S REPUBLIC OF CHINA.
        Notwithstanding any other provision of law, the President may exercise the      authority under section 212(f) of the Immigration and Nationality Act (8 U.S.C.     1182(f)) to deny the entry into the United States of any alien who—
         (1) holds a position in the senior leadership of the Government of the      People’s Republic of China;
         (2) is an immediate family member of a person inadmissible under paragraph(1);
         (3) through his or her business dealings with senior leadership of the      Government of the People’s Republic of China derives significant financial      benefit from policies or actions, including human rights abuses or corruption,     that undermine or injure democratic institutions or impede the transition to      democracy in the People’s Republic of China;
         (4) has participated in the imposition of the People’s Republic of China’s      coercive birth limitation policy; 
         (5) has participated in the violent repression or any other form of      persecution of Tibetans, Uyghurs, Mongolians, or any other ethnic minority;
         (6) has participated in the trafficking of North Korean refugees or the      forcible return to North Korea of such refugees, knowing that such refugees      will be persecuted upon their return; or
         (7) is a member of any branch of the security or law enforcement services of     the People’s Republic of China and has participated in the violent repression,     imprisonment, torture, or any other form of persecution of any individual in      violation of the human rights of such individual, including—
         (A) members or leaders of religious groups;
         (B) democracy advocates, organizers, or demonstrators;
         (C) individuals or members of organizations or public interest law firms       involved in human rights defense or advocacy or public interest issues;
         (D) workers’ rights advocates; or
         (E) individuals involved in independent media, journalists, or Internet users
